Neilson’s Nutrition – My Meal

These Terms of Service govern all transactions between Neilson’s Nutrition (Pty) Ltd (“Neilson’s Nutrition”, “we”, “us”, or “our”) and the Shopper related to the purchase of products, including My Meal, via our online store.

  1. Definitions
  • “Neilson’s Nutrition” refers to Neilson’s Nutrition (Pty) Ltd.
  • “Product(s)” means any goods, including My Meal, offered for sale by Neilson’s Nutrition via the online store.
  • “Shopper” means any natural or juristic person purchasing Products from Neilson’s Nutrition and includes their representatives, successors, and permitted assigns.
  • “Terms and Conditions” refer to this agreement governing all online sales through Neilson’s Nutrition’s digital platform.
  1. Legal Compliance

Nothing in these Terms and Conditions is intended to unlawfully limit, exclude, or avoid any rights or obligations applicable under the Consumer Protection Act, 68 of 2008, or other applicable South African laws.

  1. Orders
  • Orders will be processed in accordance with Neilson’s Nutrition’s standard business procedures.
  • Confirmation of orders will be issued to the Shopper via email.
  • Neilson’s Nutrition reserves the right to reject any order, at its sole discretion, with or without providing reasons.
  1. Payment (Daren, not sure which payment gateway will be used, please advise)
  • Payments must be made in full prior to order dispatch.
  • Payment methods include:
    • Credit Card payments processed via PayFast, a registered South African payment gateway. View their policies at www.payfast.co.za.
    • Payflex, offering interest-free instalments over six weeks. See www.payflex.co.za for full terms and privacy policies.
  1. Pricing
  • All prices are quoted in South African Rand (ZAR) and include VAT.
  • The listed prices on the website represent the current official price list of Neilson’s Nutrition and are deemed accepted by the Shopper upon placing an order.
  • Prices are subject to change due to external market factors such as exchange rates, transport costs, or inflationary pressures.
  • It is the Shopper’s responsibility to confirm the purchase price at checkout before purchase.
  • Promotions, discount codes, or exclusive offers may be made available but are not combinable unless explicitly stated.
  1. Delivery and Ownership
  • Products remain the sole property of Neilson’s Nutrition until full payment has been received.
  • Delivery terms are governed under our separate Delivery & Shipping Policy.
  • Risk transfers to the Shopper upon confirmed delivery to the specified address.
  1. Cancellations and Refunds

Refunds and cancellations are governed by our separate Refund Policy, which aligns with the Consumer Protection Act and includes a 7-day “cooling-off” period for eligible returns.

  1. Modifications to Terms and Products

Neilson’s Nutrition reserves the right to:

  • Update or amend these Terms of Service at any time. Continued use of the site after changes implies acceptance of the revised terms.
  • Add, modify, or discontinue any product or service offered on the site without notice or liability.
  • Suspend or terminate access to our website or cancel orders suspected to be fraudulent or in violation of our terms.
  1. Warranty and Defective Products
  • Neilson’s Nutrition warrants that it has the legal right to sell all products offered, including My Meal.
  • If a product is found to be defective, Neilson’s Nutrition may, at its sole discretion, replace it provided:
    • Notification of the defect is made in writing to info@nn.co.za within 7 (seven) days of delivery; and
    • The defect is confirmed through inspection and not due to misuse, negligence, or mishandling by the Shopper.
  1. Limitation of Liability

Neilson’s Nutrition shall not be liable for indirect, incidental, or consequential damages arising from use, misuse, or inability to use the product or platform, to the maximum extent permitted under South African law.

  1. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of KwaZulu-Natal.
